Recommendation on Protection of Convict’s Labour Rights
On September 9, 2024, the Public Defender of Georgia submitted a recommendation to LLC Ili Group regarding the violation of the labour rights of convicts employed in an enterprise operating in a penitentiary institution.
The Public Defender considered LLC Ili Group to be an administrative body in the part of the activity in which a convict was employed in the company on the basis of an employment contract.
The Public Defender of Georgia determined that the employment contracts were concluded in violation of the rules specified in Article 12 of the Organic Law of Georgia Labour Code of Georgia and the convict was restricted for years in his right to enjoy his paid leave or to be protected from unjustified dismissal.
In his recommendation, the Public Defender requested that, in order to restore the convict's labour rights, the company consider: 1. the legality of terminating the employee's labour relationship due to the expiration of the contract, 2. the conclusion of an employment contract before the expiration of the prison term, and 3. compensation for the forced missed hours.
