About the Department

Analytical Department

The Analytical Department is the primary structural unit of the Public Defender's Office of Georgia. It includes the Statistics Division as a secondary structural unit. When carrying out its functions, the Department shall act on behalf of the Public Defender of Georgia. The Department is accountable to the Public Defender of Georgia and the Deputy Public Defender of Georgia, who exercise official supervision over it in accordance with the rules established by law. The Statistics Division is accountable to the Head of the Analytical Department, the Public Defender and the Deputy Public Defender. The purpose of the Department shall be to facilitate the implementation of systemic changes through qualified analytics, quality reports and recommendations and systemic follow-up.

The functions of the Department shall be to:

  • Develop and periodically update the internal statistical data processing methodology (it shall reflect the geographical, content-related, thematic, rights-related and other components);
  • Receive, sort and process relevant statistical data of the Public Defender's Office in accordance with the internal statistical data processing methodology document and provide them to the staff of the Public Defender's Office through electronic platform, in accordance with the internal statistical data processing methodology document;
  • Enter the internal documentation, recommendations and other internal and external documents into the unified system accessed by other structural units of the Public Defender's Office; properly develop this base;
  • Make generalized analysis of internal statistical data on a quarterly basis;
  • Draw up statistical reports periodically, as needed, for the internal use or for the submission to the relevant state/international agencies;
  • Create and periodically update the statistical data processing methodology document for different structural units of the Public Defender's Office; request, collect and sort, if necessary, the statistical data important for different thematic departments of the Public Defender’s Office and provide them to the relevant staff;
  • For the implementation of the recommendations issued in the annual and special reports of the Public Defender of Georgia, make analysis of the state budget/draft budget (and attached documentation), communicate with state agencies and coordinate with the staff of the Public Defender of Georgia; organize a working format with the Ministry of Finance of Georgia for the implementation of the recommendations endorsed in the Resolution of the Parliament of Georgia (where additional allocation of relevant funds is necessary);
  • Develop guiding document for drawing up an annual report of the Public Defender, analyze the practices of comparative law for this purpose, in order to continuously improve the methodology/format;
  • For the purpose of drawing up an annual report of the Public Defender of Georgia, cooperate with the relevant structural units and prepare a report (in order to perform this function, the Analytical Department of the Public Defender's Office shall determine an action plan, schedule for requesting information and responsible persons);
  • Prepare special reports of the Public Defender's Office on issues that do not belong to the functional description of any department; as well as prepare/coordinate the preparation of the special reports of the Public Defender's Office that simultaneously fall under the functional description of two or more departments;
  • Collect, systematize and analyze the results of the shadow reports sent by the Public Defender's Office; identify the international treaties/mechanisms that allow the submission of shadow reports, with reference to the relevant procedures;
  • Draw up shadow reports together with the thematic departments and submit them to the relevant international organizations;
  • Prepare or coordinate the preparation of reports to be submitted to international organizations, which involves the secondary and additional analysis;
  • Submit opinions in relation to the enforcement of judgments of the European Court of Human Rights against Georgia; submit the third party opinions to the European Court of Human Rights;
  • Analyze the report submitted by the Government of Georgia to the Parliament of Georgia, information of which is submitted to the Parliament on the basis of Articles 2281, 2282and 2283of the Rules of Procedure of the Parliament and prepare the relevant report on it;
  • Analyze various international reports submitted to the Parliament and state agencies relating to human rights and, if necessary, submit the opinion of the Public Defender's Office to the Parliament;
  • Periodically review and analyze draft laws, prepare legal opinions on them and identify the changes that need to be made to them;
  • Monitor the implemented legislative changes and prepare periodic reports on them (in cooperation with the relevant thematic department), for their further submission both to the Public Defender and the Parliament;
  • Analyze the results of the consideration of the draft law(s) submitted by the Public Defender’s Office and/or reasons of the rejection and communicate it with the management of the Public Defender's Office and the relevant structural unit;
  • Prepare an action plan for the implementation of the parliamentary resolution adopted after the presentation of the parliamentary report; implement the action plan/hold meetings with agencies and review the progress report;
  • In case of preparation of a special report, draw up an action plan for the implementation of its recommendations and participate in its implementation;
  • Prepare speeches for the Public Defender/Deputy Public Defender with the involvement of the relevant thematic department (if necessary);
  • Develop formats of communication and working meetings with the relevant state agencies;
  • Prepare thematic studies and/or analysis of legislation on human rights issues, when the implementation of such a study cannot be conducted by thematic departments;
  • Identify shortcomings in the Organic Law of Georgia on the Public Defender, suggest remedies and advocate for them before the Parliament of Georgia;
  • Periodically update the Public Defender's strategy;
  • If necessary, by the decision of the Public Defender/Deputy Public Defender, measure and evaluate the annual performance of the thematic departments in terms of statistics and content;
  • Prepare relevant recommendations and provide them to the structural units of the Office in order to improve the development of proposals/recommendations;
  • Perform other functions inherently related to the specifics of the department.
