Proposal for the Chief Prosecutor of Georgia Regarding a Possible Fact of Improper Treatment of a Convict
On November 5, 2014, the Public Defender of Georgia addressed the Chief Prosecutor of the Georgia with a proposal to start an investigation into a fact of a possible improper treatment of convicted A.Z. placed in the establishment N6 of the Penitentiary Department.
During a meeting with representatives of the Public Defender the convict had various kinds of damages on the body: a hyperemic section in the eye-socket area on his face, bruises in upper right part of the face, oval-form redness in a right upper limb, while a broad hyperemic section was noted on the back along with vertical bruises also. According to the convict, in the period of October 28-31, he was constantly subjected to an improper treatment.
The Public Defender of Georgia called on the Chief Prosecutor’s Office of Georgia to immediately start and conduct investigation into the possible improper treatment; to conduct a medical forensic examination in a timely manner to determine degree, nature, age, origin and development of three injuries on A.Z.’s body; for investigation bodies to timely issue video recordings depicting the mentioned fact.
During their conversations with representatives of the Public Defender, other convicts in the in the establishment N6 of the Penitentiary Department refer to numerous violations of the law by workers of this very penitentiary establishment. The Public Defender’s Office has already started studying applications of the convicts and realization of relevant responses.
The Public Defender of Georgia calls on the Ministry of Corrections of Georgia to study the situation in the establishment N6 of the Penitentiary Department and take all the measures not to violate rights of prisoners placed in establishment, to safeguard their interests and ensure appropriate prison conditions to protect dignity and respect of a human being .
