The Public Defender’s Office of Georgia has drawn up a special report summarizing the state of implementation of the tasks given to state agencies by the Parliament’s Resolution of October 18, 2022 based on the 2021 Report of the Public Defender on the Situation of Human Rights and Freedoms in Georgia.

In the 2021 Parliamentary Report, the Public Defender issued 334 recommendations to state agencies, autonomous republic and municipal bodies, as well as officials. The Parliament of Georgia shared approximately 81.62% of the mentioned recommendations and issued 316 tasks to ensure their implementation. The sharing rate of the Public Defender's recommendations by the Parliament in 2022 is similar to the rate of 2021 (82%).

The present report evaluates the tasks given by the Parliament to state agencies, a total of 292 tasks. Out of these: 33 tasks were not evaluated due to the substantial change of their content by the Parliament; It was impossible to assess the state of implementation of 7 parliamentary tasks due to the failure of state agencies to provide relevant information to the Parliament of Georgia and the Public Defender’s Office; Additionally, 5 tasks were not evaluated on the ground of duplication.

The analysis of the tasks issued by the Parliament made it clear that the implementation rate of the tasks is still unsatisfactory:

• About 19% of the tasks were fully implemented;
• 24% were partially implemented;
• 36% were not implemented.

It should be positively noted that the number of recommendations that the Parliament did not reflect in the resolution has been reduced. In particular, in the 2022 Resolution, the Parliament did not reflect 23 recommendations from the 2021 Parliamentary Report of the Public Defender, while in 2021 this figure was 30. The list of mentioned recommendations is attached to this special report as an appendix.

The fact that, compared to the last year, the performance rate of the tasks, which according to the Public Defender's assessment were fully or partially implemented, has increased is welcome. The number of tasks that were not implemented has also reduced.

The Parliament of Georgia passes a resolution based on the annual report of the Public Defender of Georgia. With the mentioned act, the Parliament evaluates the Public Defender's Report on the Situation of Human Rights and Freedoms in Georgia and gives tasks to state agencies to implement the recommendations presented in the report. The assignment of tasks by the Parliament brings the implementation of the recommendations issued by the Public Defender under parliamentary oversight. For this purpose, the Human Rights and Civil Integration Committee of the Parliament of Georgia monitors the implementation of the Parliament's tasks by the agencies. Unfortunately, the Committee has not held a discussion regarding the fulfillment of tasks this year, as in previous years.[1]

The Public Defender once again calls on the state agencies to realize the importance of implementing the tasks issued by the Parliament of Georgia, and, in turn, calls on the Parliament of Georgia to strengthen the practical use of all the control mechanisms provided for by the Constitution of Georgia and the Rules of Procedure of the Parliament, in order to improve the implementation rate of the tasks issued by the Parliament.

[1] In accordance with Article 6, paragraph 4, sub-paragraph "b", of the Statute of the Human Rights and Civil Integration Committee of the Parliament of Georgia, the Human Rights and Civil Integration Committee of the Parliament of Georgia shall examine the implementation of the tasks set forth in the Resolution of the Parliament of Georgia by the addressees and shall conduct a committee session with the participation of the Public Defender and the addressees of the recommendations.
