Written Opinion of the Public Defender of Georgia Addressed to the UN Human Rights Council
On January 26, 2015, the Public Defender of Georgia presented a written opinion to the UN High Commissioner for Human Rights in the framework of the Resolution 27/32 of the UN Human Rights Council ”Human rights, sexual orientation and gender identity”. The written opinion of the Public Defender of Georgia reflects legal right situation of LGBT persons in Georgia. Special attention is paid to facts of violation of rights of labour, health, social and economic rights on the basis of sexual orientation and gender identity; also,
on May 17, 2013, events developed during International Day against Homophobia and Transphobia.
The written opinion of the Public Defender notes that LGBT persons experience violence and unequal treatment in various areas, families and society. Along with homophobic attitudes in the society another challenge is the issue of timely, effective and accountable investigation into hate crimes. None of the facts that took place on May 17, 2013 were followed with legal consequences and no one was punished for committing hate-based physical violence. In addition, needs of transgender persons are not appropriately presented in the legislation and that in some cases, results in violation of their fundamental human rights.
