Public Defender Files Amicus Curiae Brief with European Court of Human Rights relating to Rustavi 2 Case
On May 25, 2018, Public Defender Nino Lomjaria filed an amicus curiae brief with the European Court of Human Rights in the case of Broadcasting Company Rustavi 2 and Others V. Georgia. On April 4, 2018, the Court granted the request of the Public Defender of Georgia with regard to a third party intervention in the case.
In accordance with the instruction of the Court’s Section President, the opinions submitted by the Public Defender do not concern the factual circumstances of the case or the merits of the dispute. In the amicus curiae brief, the Public Defender acts only within her mandate and focuses on the importance of the case, as well as the situation of and challenges relating to freedom of expression and fair trial in the country.
In accordance with the procedure established by the Rules of Court, parties, applicants and governments shall have the opportunity to express their position on the issues reviewed in the amicus curiae brief.
It should be noted this is the second amicus curiae brief filed by the Public Defender of Georgia with the Strasbourg Court.
