Ministry of Internally Displaced Persons from Occupied Territories, Refugees and Accommodation Partly Fulfils Public Defender’s Recommendation
The Ministry of Internally Displaced Persons from the Occupied Territories, Accommodation and Refugees of Georgia has partly fulfilled the Public Defender’s recommendation to compensate internally displaced person P.K. for the not-received IDP’s allowance.
P.K.’s status of internally displaced person had been suspended in 2008-2013 as he failed to pass registration. As a result, his allowance was also suspended.
In March 2013, as a result of appealing, the applicant’s status of internally displaced person was restored and the allowance was resumed respectively, but was not compensated for the suspended aid despite the fact that it was provided for by the legislation. In particular, if the ground for suspension of allowance is eliminated, IDPs should be compensated for the suspended aid within the ongoing budget year. Given that the ground for suspending P.K.’s allowance was eliminated, the Public Defender issued a recommendation on compensating the applicant for the period of 2008 – 2013.
The Ministry of Internally Displaced Persons from the Occupied Territories, Accommodation and Refugees expressed readiness for compensating the applicant only for January and February of 2013. The Public Defender considers that the Ministry’s position on not compensating for the period of 2008-2012 does not comply with the law and violates P.K.’s rights.
