National Agency of Public Registry Violates Juvenile’s Right
On May 30, 2016, the Public Defender of Georgia addressed the National Agency of Public Registry concerning the violation of the property right of juvenile I.Ch. by the Gardabani Registration Office of the Agency.
In particular, by the decision of Tbilisi City Court’s panel of civil cases, the representative right of the juvenile’s father Z.Ch. had been limited concerning the use and sale of the child's real estate.
On March 27, 2015, Z.Ch. presented an agreement on transfer of the child’s real estate to his ownership at the Gardabani Registration Office, which he, as the child's legal representative, signed with himself, and demanded registration of the property right.
Although the abovementioned was in contradiction with a number of norms of the Georgian legislation, the Gardabani Registration Office registered Z.Ch’s property rights on April 1, 2015.
In the present case the Public Defender held that I.Ch’s property right was violated and addressed the National Agency of Public Registry with a proposal to cancel the decision on registration of Z.Ch’s property right, as well as to launch disciplinary proceedings against the employees of the Gardabani Registration Office that took the decision on the registration of the property right.
