The given document reflects the situation of implementation of recommendations included in the report of June 8, 2012, prepared by Maina Kiai, United Nations Special Rapporteur on the rights to freedom of peaceful assembly and of association.

Out of the recommendations prepared for the state of Georgia, the Public Defender discussed recommendations related to the rights of freedom of association and of peaceful assembly.

Recommendations on freedom of association concerns improvement of legislative base and close cooperation with the civil society in this area, with special attention focused on the Election Code, equal environment in the pre-election period, signing of international documents and strict control of their implementation.

Necessity for legislative changes on the basis of advices of international organizations was underlined in the recommendations on the right to peaceful assembly as well. The Special Rapporteur called on the Government of Georgia to avoid the use of force against legal and peaceful demonstrations and to thoroughly investigate previous cases; to take necessary measures to prevent arbitrary detentions, and at the same time, to ensure enforcement of the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

The Public Defender's Office has thoroughly studied the situation of the implementation of the recommendations and introduced it at the public debate on April 15, 2016.
