Public Defender Files Amicus Curiae Brief concerning Alleged Discrimination during Appointment of Judge
On November 13, 2017, the Public Defender addressed Tbilisi City Court with amicus curiae brief regarding a suit, in which the plaintiff indicated that he/she was not appointed to the judge’s position by the decision of the High Council of Justice of Georgia due to his/her different opinion and membership of association.
Taking into consideration the importance of this issue for the Georgian justice, the Public Defender decided to file amicus curiae brief, in which he presented a test of identification on the basis of the standards established by the Constitutional Court of Georgia and the international institutions in order to establish a case of discrimination on grounds of membership of association and expression of different opinion, as well as to emphasize the importance of distribution of the burden of proof in the discrimination cases.
The plaintiff’s interests are represented by the Human Rights Education and Monitoring Center (EMC) and the Georgian Young Lawyers' Association.
