The Public Defender Addressed the Ministry of Education and Science of Georgia with a Recommendation
The Public Defender of Georgia addressed the Ministry of Education and Science of Georgia with a recommendation to examine how appropriate and legitimate is conduction of audio-video recording of the process of consultation of a pupil by the Psychological Service Department of the Office of Resource Officers of Educational Institutions of the Ministry of Education and Science of Georgia, as well as elaboration, storing and later usage of the gathered personal data.
In accordance with the factual circumstances of the case, LEPL Psychological Service Department of the Office of Resource Officers of Educational Institutions of the Ministry of Education and Science of Georgia that provides psychological aზssistance to pupils aged 6 -18 plans to conduct the above-mentioned activities in a room equipped with video-camera. This can become a basis for recording, storing and further elaboration of videos of meetings of underage students with a psychologist.
The Public Defender believes that the audio-video recording of the work process conducted by the Psychological Service Department of the Office of Resource Officers of Educational Institutions represent illegitimate and ungrounded interference into a personal space of a minor that creates risks of violation of negative obligation existing towards a state.
