Public Defender's Office Echoes Recent Developments in Schools
Minors have the fundamental right to express their opinion and participate in peaceful protests, which is guaranteed by national and international legislation, including the Constitution of Georgia, the UN Convention on the Rights of the Child and the Code on the Rights of the Child. These rights ensure the minors’ freedom of expression, assembly and participation in public life.
It is important for the State and society to respect and protect the freedom of expression of minors, create a safe and supportive environment for the realization of children's rights. In the event that children wish to leave school in order to protest during the educational process, the educational institution is obliged to immediately notify the minor's parent/legal representative about this.
It is unacceptable for minors to become objects of reproach and threats when expressing protest, and it is also unacceptable for an unauthorized person to enter the school premises to call on children to leave school and to disrupt the study process.
We call on educational institutions to protect the rights of the child, to ensure a safe and calm educational environment on the one hand, and to respect the freedom of expression of minors on the other hand.
In addition, it should be emphasized that protecting the safety and interests of children should be one of the most important values and obligations of society.
The Public Defender's Office will study each case and will respond to all of them appropriately, within the scope of its authority.
