Public Defender Appeals against Prohibitions and Liabilities Related to the Rules for Holding Assemblies and Demonstrations to Constitutional Court
The Public Defender of Georgia has filed a constitutional complaint with the Constitutional Court of Georgia. The constitutional complaint challenges the prohibitions set forth in the Law of Georgia on Assemblies and Demonstrations for participants in assemblies or demonstrations, including the blanket prohibition on covering the face with a mask or any other means.
Along with the substantive prohibitions related to the rules for holding assemblies and demonstrations, the constitutional complaint challenges the composition of liability provided for by the Administrative Offences Code of Georgia, both detention without alternative and the amount of the fine provided for by law.
In addition, the constitutional claim challenges the criminal liability established by the Criminal Code of Georgia, which provides for the deprivation of liberty for the repeated commission of an action by participants in an assembly or demonstration, including minors and organizers subject to administrative punishment.
