Public Defender Submits Another Communication relating to the Case of N.Ts. and Others v. Georgia

The Public Defender of Georgia submitted another communication to the Committee of Ministers of the Council of Europe on the state of the execution of the judgment of the European Court of Human Rights in the case of N.Ts. and Others v. Georgia.

The European Court of Human Rights found in the case that children were not properly involved in the proceedings at the national level and that the national courts failed to adequately protect the best interests of the children.

In its decision, the European Court of Human Rights found problematic both the legal form of social workers’ participation in the proceedings – as interested persons – and the formal nature, which failed to ensure the protection of the best interests of the child.

It is noteworthy that the Government of Georgia, in its action report submitted in July 2025, once again requested the Committee of Ministers to close the case, on the grounds that the State had taken all individual and general measures to execute the case.

The Public Defender of Georgia notes in the submitted communication that although the Georgian Government has taken steps to bring national legislation into line with the judgment of the European Court of Human Rights, its implementation in practice remains flawed. Structural and procedural shortcomings, particularly in terms of child representation, child-friendly justice mechanisms and qualifications of specialists, continue to hinder the effective protection of children's rights in accordance with Article 8 of the Convention.
