On June 3, 2020, for the first time, the Public Defender of Georgia submitted an alternative report on the situation of enforcement of the decisions of the European Court of Human Rights and the United Nations Committee against Torture to the Parliament of Georgia.

The alternative report assesses the implementation of general measures imposed on Georgia by the European Court of Human Rights in the so-called Tsintsabadze Group and Identity Group cases, the measures taken and/or to be taken by the State in order to enforce the decisions. The document also reviews the enforcement of the decision made by the United Nations Committee against Torture in the case of J.C. And J.E. v. Georgia.

The report addresses issues, such as the challenges of combating discrimination, fight against torture and ill-treatment, activities of investigative bodies/investigation of cases of ill-treatment, identification and documentation of cases of violence, as well as reporting to the investigation, the role of judges in the investigation of ill-treatment, involvement of victims in the investigation, etc.

Based on the issues discussed in the alternative report, the Public Defender’s Office developed recommendations for the Government and submitted them to the Parliament of Georgia in order to promote full implementation of the decisions made by the international mechanisms on the above-mentioned cases.

It should be noted that in accordance with the amendments made to the Rules of Procedure of the Parliament of Georgia in 2016, the Government of Georgia, in the form of the Ministry of Justice of Georgia, shall annually submit a report on the situation of enforcement of decisions of international mechanisms to the Parliament of Georgia. In addition, stakeholders have the opportunity to present their alternative opinions and assessments during the Committee session.
