Tbilisi Court of Appeal and Penitentiary Establishment No. 12 Implements Public Defender’s Recommendations regarding Ensuring the Right to Access Public and Personal Information

The Public Defender of Georgia welcomes the implementation of recommendations by the Tbilisi Court of Appeal and Penitentiary Establishment No. 12.

Within the framework of the study of the cases, the Public Defender identified restrictions on Article 18 of the Constitution of Georgia by public institutions, which includes, among others, the right to access public and personal information.

In particular, the Tbilisi Court of Appeal did not provide one of the applicants, without any justification, with information about the judges specializing in labour law of the Civil Cases Chamber of the same court. Considering this fact to be a violation of the right to access public information, on November 3, 2025, the Public Defender of Georgia addressed the Chairman of the Tbilisi Court of Appeal with a recommendation to issue information.

In addition, on November 11, 2025, the Public Defender of Georgia addressed the Director of the Semi-Open and Closed Penitentiary Facility No. 12 with a recommendation to ensure that a convicted person, who had repeatedly requested his personal information, is provided with the relevant documentation/information in accordance with the procedure established by law.

Public institutions followed the Public Defender's recommendations and provided the requested information to the citizens.
