General Proposal to Tbilisi City Court and High Council of Justice on Maintenance of Statistics on Cases of Discrimination
On December 9, 2016, the Public Defender of Georgia addressed the High Council of Justice and Tbilisi City Court with a general proposal to maintain statistical data on the cases of gender-based harassment, sexual harassment and other discrimination.
The Public Defender considers that the lack of access to the information diversified according to gender or other signs limits the opportunities of independent researchers and non-governmental organizations to study the court practice relating to discrimination cases, whereas they can play an important role in the fight against various forms of discrimination and violence against women. Thus, it is important that they be provided with real information about the situation of equality in the country by the agencies responsible for studying the cases of discrimination.
Keeping that in mind, the Public Defender addressed Tbilisi City Court with a general proposal to formulate the judgments in the gender discrimination cases so that the gender of associated persons, as well as religious, racial, ethnic, national or other affiliations in the cases of discrimination on other grounds, are identifiable, which is important for the detection of discrimination. In addition, the Public Defender addressed Tbilisi City Court to elaborate information about the discrimination cases so that the protection from discrimination and the result of the review of cases are indicated. The Public Defender also addressed the High Council of Justice to spread the standard provided in the proposal in all three instances of the court.
