Public Defender Considers that New Studio Video is against Child’s Best Interest

The Public Defender of Georgia addresses New Studio, which has prepared the advertising “Santa Claus was caught by Grandfather Frost”, to stop circulating the advertising and to show particular caution with regard to the protection of the child’s rights in the future.

The Public Defender considers that the video released on the Internet, where Georgian Grandfather Frost kills Santa Claus on the motive that he thinks that "a real man should enter the room through a door", which is witnessed by a child, has negative impact on both the involving child and other juveniles, the great part of which have easy access to the video despite its restriction on juveniles under 18.

The Law of Georgia on the Advertising prohibits the abuse of juvenile’s naivety and inexperience, as well as the use of the kind of text, audio or video information that shows a child in a dangerous situation or place. In addition, the United Nations Committee on the Rights of the Child clearly states that juveniles should be protected from getting information through technological means, as a result of which, they may be influenced by aggressive, violent advertising.

At the beginning, the advertising shows the New Year atmosphere, which attracts the child's attention. However, it is followed by a violent scene attended by a child. There is a danger that children may improperly perceive the story of the advertising, which may have a negative impact on their development.

The Public Defender notes that it is vitally important to consider child’s best interests in the advertisings involving or targeting children.
