Special Report on Administration of Justice relating to Child's Relationship with Both Parents

The Public Defender’s Office of Georgia, with the support of the USAID Rule of Law Program, has prepared a Special Report on Administration of Justice relating to Child's Relationship with Both Parents.

The document addresses challenges relating to children's relationship with both parents and the legal regulation and practice in the process of administration of justice relating to the cases of separation of the minor from the parent, including issues of timely restoration of the child's relationship with the parent, enforcement of court rulings, separation of the minor from the parent, reintegration of the minor with the family and support to children and parents in this regard.

The report is based on the analysis of 13 cases on the child's relationship with both parents, 15 rulings and 214 orders on the separation of the child from the parent, information requested from all relevant state agencies and interviews with relevant specialists, covering the period of 2020-2021. The above information was analyzed considering interdisciplinary and international standards.

Based on the challenges identified as a result of the research, the Public Defender’s Office developed recommendations to improve the existing legislation, policy and practice regarding the child's relationship with both parents.
